Terms of Use of Parking Lot

FUTATABI FUTABA FUKUSHIMA (hereinafter referred to as the “Hotel”) has established these Terms under the following provisions to ensure that the guests to the Hotel can safely and comfortably use the parking lot managed by the Hotel (hereinafter referred to as the “Parking Lot”). The users of the Parking Lot of the Hotel shall abide by these Terms and also assume the obligation to make their passengers abide by these Terms. Furthermore, as our Parking Lot is not open to the public, those simply passing through the Parking Lot must also abide by these Terms. (Hereinafter, users, passengers, and passersby are collectively referred to as “User”)

(Purpose)

Article 1

The purpose of the Parking Lot is to provide the guests to the Hoel with parking spaces for their vehicles, and the Hotel is not responsible for the custody and management of vehicles and cargoes. The guests shall not use the Parking Lot for any other purpose other than that specified.

(Disclaimer)

Article 2

  1. The Hotel shall not be liable for any of the followings:
    • (1) Any accident, theft, trouble, etc. occurring in the Parking Lot (including those occurring due to the facilities installed in the Parking Lot);
    • (2) Any theft, loss or damage occurring to vehicles and cargoes in the Parking Lot;
    • (3) Damage incurred by User due to acts of other Users or third parties;
    • (4) Damage incurred by User due to vehicles in the Parking Lot or their accessories or cargoes;
    • (5) Damage incidental to occurrence of natural disasters, wars, riots, and other force majeure events;
    • (6) Damage incurred by User due to his/her act in violation of these Terms and Conditions.
  2. The Hotel shall not compensate for any waiting time or opportunity loss incurred by User as a result of the preceding paragraph, nor shall the Hotel compensate for any transportation expenses incurred in relation to travel without the Hotel’s consent.
  3. The Hotel shall not bear any liability for damage incurred by User as a result of the acts of the Hotel pursuant to these Terms and Conditions other than one incurred by User due to a willful intention or gross negligence on the Hotel.

(Illegally Parked Vehicles)

Article 3

Any of the following vehicles shall not be parked:

  • (1) Unregistered vehicles, vehicles with expired vehicle inspection certificates, vehicles that are prohibited from driving on public roads, vehicles that are unidentifiable due to temporary registration, stolen vehicles, illegally modified vehicles, and vehicles that cannot drive under their own power;
  • (2) Any vehicle for specialized purposes, including large specialized vehicles or vehicles for specialized construction purposes, that might cause damage to parking facility equipment or machinery;
  • (3) Any vehicle without the vehicle registration number, or any unidentifiable vehicle including vehicles whose registration number is covered;
  • (4) Any vehicle whose registration details has not been updated in spite of changes in such vehicle’s details;
  • (5) Any vehicle that has accessories or other items attached to it and that might cause damage to the parking facility equipment or machinery and/or other vehicles (including users) through contact;
  • (6) Any vehicle loaded with dangerous goods, toxic pollutants, or any other material that might be hazardous to health and safety;
  • (7) Motorcycles (including those with a sidecar), motorized bicycles, and small specialized vehicles which are not permitted to be parked under a notice posted at the Parking Lot;
  • (8) Other vehicles whose parking causes a hindrance to the management of the Parking Lot.

(Parking Time)

Article 4

Users are entitled to park their vehicles during the time when they use the Hotel in principle.

(Prohibited Acts)

Article 5

  • User shall not engage in the following acts:
  • (1) Use of the Parking Lot under the influence of alcohol or drugs;
  • (2) Idling or revving, using car stereos at high volume, opening and closing doors roughly, talking loudly, and other actions that cause a nuisance to neighbors;
  • (3) Parking at a place other than a parking space or parking across parking spaces;
  • (4) Leaving or dumping garbage, smoking, using fire, urinating or defecating, and other unsanitary behavior;
  • (5) Conducting business, speech, advertising, fundraising, signature campaign, or any other activities other than parking within the Parking Lot.

(Handling of Abandoned Vehicles)

Article 6

The Hotel may take the following measures when User continues parking without permission and fails to abide by notices from the Hotel:

  • (1) In the event where User parks his or her vehicle for longer than the prescribed time without approval of the Hotel, the Hotel may request such User to remove the vehicle before a date designated by the Hotel by notifying such User or displaying such request at the Parking Lot;
  • (2) In the case of the preceding Paragraph, if the User refuses or is unable to remove his or her vehicle or if the Hotel is unable to ascertain the identity of the User without the Hotel’s gross negligence, the Hotel may transfer the vehicle to the vehicle owner or user listed on the motor vehicle inspection certificate (hereinafter referred to as the “owner, etc.”) by requesting the owner, etc. to remove the vehicle before a date designated by the Hotel through notifying the owner, etc. or displaying such request at the Parking Lot. In such a case, it shall be deemed that the User has waived all of his or her rights associated with the transfer of the vehicle, and the User shall not file any claim or objection whatsoever to the Hotel;
  • (3) In the event that the vehicle is not removed before the date designated by the Hotel in spite of the Hotel making a written request for removal as set forth in Paragraph (1) and Paragraph (2), the Hotel may deem that the owner, etc. has refused to remove the vehicle;
  • (4) In the case of Paragraph (1), the Hotel may inspect the vehicle (including the vehicle interior) to the extent necessary in order to ascertain the identity of the User or the owner, etc.;
  • (5) In the case of Paragraph (1), if the vehicle impedes management of the Parking Lot, the Hotel may move the vehicle elsewhere after notifying the User or the owner, etc., or displaying such notice at the Parking Lot;
  • (6) If the User or the owner, etc. refuses or is unable to remove his or her vehicle or if the Hotel is unable to ascertain the identity of the User or the owner, etc. without the Hotel’s gross negligence, and, in spite of the Hotel providing a warning and a period of time for removal of the vehicle by notifying the User or the owner, etc. or displaying the warning at the Parking Lot, the vehicle has not been removed within such period of time, the Hotel may, upon notifying the User or the owner, etc. or displaying advance notice at the Parking Lot, sell, discard, or otherwise dispose of the vehicle after three (3) months have passed since the date of the warning. In such instance, if it is clear that the market value of the vehicle is less than the amount of expenses required for sale of the vehicle (including vehicle storage expenses after the warning), the Hotel may, upon notifying the User or the owner, etc. or displaying advance notice at the Parking Lot, sell, discard, or otherwise dispose of the vehicle immediately after the expiry of the time limit for removal;
  • (7) In the event where the Hotel disposes of the vehicle in accordance with the preceding Paragraph, it shall without delay notify the User or the owner, etc. to that effect or display such a notice at the Parking Lot;
  • (8) In the event where the Hotel disposes of the vehicle in accordance with Paragraph 6, it shall deduct from any income arising from disposal any expense required for storage, relocation, or disposal of the vehicle, and claim payment from the User if there is any shortfall or return to the owner, etc. the remainder if any amount remains.

(Liability for Damage)

Article 7

User shall compensate the Hotel for any damage incurred by the Hotel (including operating profits lost by the Hotel when the Hotel inevitably suspended business operations of the Parking Lot in whole or in part) due to breaches of these Terms of Use or any rules displayed at the Parking Lot by the User or due to damage caused to any parking facility equipment or machinery as a result of willful intention or negligence of the User. Compensation for damages, various expenses for repairs, investigations, etc., parking fees, etc. shall be charged to the User. If the User cannot be identified, the charges shall be claimed to the owner, etc.

(Matters to be Observed)

Article 8

User shall observe the following matters: (1) Drive slowly and be careful of other vehicles, pedestrians, obstacles, etc. in the Parking Lot; (2) Always turn off the engine when parking; (3) When leaving your vehicle, do not leave valuables inside, close the windows, lock the doors and trunk, and take other measures to prevent theft; (4) When causing damage to equipment and facilities, and other vehicles or other users, immediately notify the Hotel; (5) Observe the content of warning signs and notices posted in the Parking Lot; (6) If there are restrictions on vehicle entry and exit due to traffic restrictions such as construction work or events, comply with those restrictions; (7) In cases other than the preceding items, follow instructions of the administrator.

(Handling of EV Charging Equipment)

Article 9

  1. The EV charging equipment is installed for the purpose of charging electric vehicles and plug-in hybrid vehicles (hereinafter referred to as “EVs”) and may only be used by the Hotel’s guests.
  2. After charging, vehicles must be moved from the parking space promptly. Prolonged occupation of the parking space for using EV charging equipment, or use of the parking space for purposes other than actual charging shall be prohibited.
  3. Use of the EV charging equipment installed in the Parking Lot shall be subject to the Terms of Use separately established by the EV charging equipment operator.

(Handling of Vehicle for Carsharing)

Article 10

  1. A vehicle for carsharing shall be provided based on the services of the carsharing business operator established within the Parking Lot of the Hotel, and only Users who completed the prescribed procedure for membership of the carsharing service may use the vehicle for carsharing.
  2. User who uses the vehicle for carsharing shall promptly return it to the exclusive parking space and shall not park it at a place other than the exclusive parking space for the vehicle for carsharing.
  3. Use of vehicles for carsharing shall follow the Terms of Use separately established by the carsharing business operator.

(Matters not Provided)

Article 11

Matters not provided in these Terms or ambiguities as to the interpretation of these Terms shall be resolved through consultation between User and he Hotel in good faith. March 6, 2026
